Policy on Scanning Copyrighted Materials1. Except as noted below, Academic Technologies will do no scanning of copyrighted materials other than color scanning for inclusion in Electronic Reserves. Faculty requesting scans of copyright documents into .PDF format or some other format should contact the Albertsons Library Circulation Department. 2. As most files in Electronic Reserves are black-and-white scans, faculty who wish to have a color document scanned must first submit a Copyright Bibliographic Information Form to the Albertsons Library Circulation Department. The form is available online. The Circulation Department will notify Academic Technologies when clearance has been obtained to proceed with the color scanning. Obtaining clearance usually takes 5 to 7 days. Therefore, Academic Technologies will accept no work for color scanning of copyrighted material into PDF format without at least 10 days prior notice. 3. The resulting files will be sent to the Circulation Department so they can be placed into Electronic Reserves. Under no circumstances will Academic Technologies release these files to the instructor, except as noted below (see Sections 4, 5, and 6, below). 4. Documents in the public domain may be scanned and the files released to the instructor. In general, documents produced by the U.S. Government are in the public domain; however, some federal agencies are exempt from this rule. (For example, works created by the United States Postal Service are copyrighted because the Postal Service is an independent establishment of the executive branch of the United States government.) For guidelines on determining whether or not a work is in the public domain, see the following web sites: 5. Documents produced entirely by the instructor may also be scanned; files may be released to the instructors if they no longer have the original files. 6. Instructors who can provide proof of permission from the copyright holder to copy and use a copyrighted work freely from semester to semester may request scanning the copyrighted documents into PDF format, and these files may be released to the instructor. 7. Based on existing workloads, Academic Technologies will determine
both the amount of pages which can be scanned and the turnaround time,
and will do so regardless of whether or not the document is in the
public domain or whether the instructor has permission to duplicate and
use the document. |
